TERMS & CONDITIONS
All products / packages detailed in this website are sold subject to the terms and conditions and same shall govern a contract between us. In the event of booking of any third party packages or products like cruise, flights, coaches, sightseeing, etc. the terms and conditions specified by such outsourced companies / tour operators including their payment schedule, cancellation, refund, etc. shall be applicable in addition to our terms and conditions.
The services comprising the travel are provided by independent entities that own or operate airlines, surface transportation, hotels, restaurants, caterers, cruises, places of entertainment, theme parks, museums, art galleries and any other special services like guide etc. Though we select reputed suppliers after we inspect their infrastructure however, we have no direct control over such services or persons providing such services or their staff. We cannot be held responsible if the contemplated service is not provided by the supplier or there is a defect or deficiency in services by any such supplier. Consequently, any injury, death, loss or damage is caused due to such independent entities does not render us liable to the Clients who have chosen us as organisers. However, in case a client is not satisfied with a particular service, we can take up the matter with the supplier if we are intimated immediately as per process described on this page.
AGREEMENT BETWEEN USER AND SAFE ESCAPES
The terms and conditions set out below apply to your use of the Site including the use of the information services offered on the Site.
RESERVATIONS & PURCHASES
PRICING & PAYMENT POLICIES
Quoted program prices are per person / double occupancy as indicated. However these prices may be modified due to unexpected significant external factors not forecasted at the time of booking. Safe Escapes is not responsible for such external factors and is under no obligation to give a breakdown in costs of any Package.
Safe Escapes will be bound to provide you the requested services subject to you making payments and complying with the relevant terms and conditions. Any correspondence with you prior to Safe Escapes’s aforesaid confirmation will not be treated as any acceptance of your request. To confirm the booking an Advance / full payment is required depending on the product you purchase. There is no fix % of amount that one needs to pay us as an advance however we reserve the right to change the % of advance and the schedule of payment required based on your product/ itinerary. The amount of payment collected shall vary from product to product and is not the same for all as some products may require full advance payments. Immediate and full payments are required in advance in cases such as train journeys, Flights, Visa , game drives, hotel bookings during peak season (Christmas/ New Year / Blackout dates for example).
Payment shall be recognised only when it arrives either with Payment Gateway or with the Bank and no payments in transit or ones made and not received at the Safe Escapes end shall be considered responsibility of Safe Escapes. Due diligence need to be made by guests while transferring payments in making sure that correct details and methods are used as recommended by the Safe Escapes personnel.
In case you need air travel assistance from our end we shall send the pricing / terms & conditions for same separately in addition to the hotel/package you have asked for unless the same is part of all inclusive /vendor package including flights. All train/air fares are quoted based on economy class seating (if no class specified by you) and is 100% non-refundable at time of air purchase. All air quotes are subject to change until final ticket is issued and required full payment in advance by Safe Escapes. Flight confirmation is based on availability. Air reservations cannot be confirmed until a passport copy / relevant documents is received by Safe Escapes.
All air carriers are independent entities and are not owned, managed or controlled by Safe Escapes. Your airline ticket constitutes a contract between yourself and the airlines (and not Safe Escapes), even if purchased through Safe Escapes. Safe Escapes is not liable for, and does not assume responsibility or accept claims with regard to, seat assignments, name changes, schedule changes, flight changes and/or cancellations. Should you change or cancel your air transportation arrangements before or after your travel begins, all airline change and cancellation / refund policies will apply.
If the client wishes to travel by his own his own Air tickets, he must provide us with correct travel details. Safe Escapes does not take ownership of any alteration in the plan arising due to change in airline schedule. Though the ticket is been issued for a particular sector by Safe Escapes may have confirmed status however due to overbooking of seats the airline offloads any passenger and accommodate on a subsequent flight for which our company will not be responsible
It is entirely your responsibility to arrange, provide and carry on tour all valid travel documents including passport, which is valid for a period of at least 6 months from date of travel. Most of the destinations require a visa so client should contact the appropriate local consular office for entry requirements pertaining to their journey. Clients also has to obtain any necessary vaccinations, and complying with customs and foreign exchange regulations. Any disadvantage resulting from non-compliance with these regulations shall be borne by the client. You may be refused boarding or disembarked from a plane, vessel or train without liability for refund, payment, compensation, or credit of any kind if you do not have proper travel documentation, and you will be subject to any fine or other costs for which Safe Escapes cannot be held responsible.
CONFIRMATION / SERVICE VOUCHERS / INVOICES
After you send us a booking / confirmation from your end we shall initiate the same from our end with the actual service providers involved to render these services like hotel, surface transportation, cruise, guides etc. and post getting a written confirmation from the service providers we in turn send a Travel Confirmation which will include (i) all details of your travel services, (ii) additional terms and conditions to Your services, if any, (iii) final payment terms based on product you purchased. After receipt of the Confirmation and full payments which is a kind of contract between You and the Company with respect to your tour / booking. Service vouchers are issued and all services would be specified vide Service voucher. A service voucher is the written confirmation of the client to travel on the tour and avail the services as applicable and paid. The Service vouchers along with Air tickets (if booked through us) and detailed itinerary, Important contact nos.(if tour package booked) will be provided 3 days prior to your departure only on full payments. Once full payments are done you can ask for an Invoice / Bill for same if required for your taxation purpose but same is not mandatory. However it is entirely your responsibility to check the Service vouchers / Tickets / Visa / Invoice / Other documents carefully and to let the company know immediately in event of any error.
CANCELLATION / AMENDMENT POLICY
In case the client wants to cancel a particular service he must intimate us in writing along with reason for cancelling mailed to us at our office hours (9.30AM – 6 PM IST) on working days. Also in case of cancellation due to medical emergency / death / unforeseen circumstances etc we would request you to send us a relevant document as well in order to intimate the service counterpart and help you get a waiver/refund if possible. There is no specific cancellation policy of Safe Escapes for cancellation and its mirrors Cancellation / amendment policy of the Hotel / service provider completely. Under any circumstances Safe Escapes is bound by the Hotel / Service Providers rules and will process cancellations and will act as per that. Safe Escapes is obliged to do co-ordination on behalf of the guest. Also note the cancellation clauses vary from product to product so exact policy will be mentioned only on your Travel confirmation based on services you are opting for and request you to pay us only post accepting the same.
In case you cancel a trip after its commencement, the refund would be restricted to a limited amount depending on the cancellation policies of the hotels / services we patronize. Full retentions are applicable in certain cases such as flights/ Safaris/ hotel during peak season and high occupancy dates.
Safe Escapes reserves the right to correct any errors or omissions in its published materials and to amend these Terms and Conditions at any time as the result of any material changes to legislation or regulation. All amended Terms and Conditions shall automatically be effective upon being posted by A&K to the website abercrombiekent.com. Accordingly, guests should check the website abercrombiekent.com prior to travel in order to ensure they are aware of any changes.
With regards to unused / unutilized services (those that are paid for and cancelled in advance), the refund amount will be offered based cancellation policy above. If the services is not cancelled due to some Force Majeure OR other factors will be completely non-refundable and future adjustments will not be made for unused sightseeing trips or meals or any non-cancelled services. However it may be sole discretion the company give the refund based on various factors like cancellation policies of suppliers like hoteliers, operators etc. the decision of the company on the quantum of refund shall be final. Refunds will be refunded directly to the person who made the original payment. All refunds will be made by the same mode as the payment was made. In case there was a MSF (Merchant Service Fee – 3%) collected during payments then the same will not be refunded and therefore be borne by the guest. In event of a credit card not in use, guests may be asked to provide alternative means of refunds. Any cost related to the alternative means, will have to be borne by the guest and refund will be paid after deducting the charge.
PUNCTUALITY / TIME CONSTRAINTS
The drivers / guides / monuments are bound by time restrictions and the package is planned having regards to same. It is therefore essential that itineraries, schedules and timings are strictly adhered by clients so as to ensure that all the services can be duly provided. In case the client misses any services due to unpunctuality and not keeping in mind the time constraints, there will be no refund nor Safe Escapes shall be held responsible for same.
The Site is for your personal non‐commercial use and the Information may be downloaded or printed by you solely for that purpose. To transact you must have the legal capacity to enter into this agreement (i.e. you should be above 18 years of age and of sound mind)
LIMITATIONS ON SAFE ESCAPES RESPONSIBILITIES
All options will not be suitable for all segments of guests and therefore guests are expected to take their own decisions and form their own judgments based on information available. When in doubt, before making a reservation / purchasing the clients are expected to raise queries and clarify issues if any. There are many inherent risks in various types of travel involved here, which can lead to illness, injury, or even death. These risks are increased by the fact that these trips take place in remote locations, far from medical facilities. Guest understands all such risks associated with taking up trips and agree to release Safe Escapes and its affiliates, service providers, their agents, employees and representatives from any liability whatsoever related thereto.
Clients are expected to adhere to local laws and Hotel rules during the stay and Safe Escapes shall not be responsible for any refunds if the guests is unable to comply to local law / Hotel / Monument rules etc and enforcement procedures / requirements.
We do not have insurance policies covering the expenses for sickness, accident, and losses due to theft or any other reason. Visitors are advised to seek such insurance arrangements in their home countries. Also, all personal property and baggage at all times is at the client’s risk.
You agree to indemnify and hold Safe Escapes, its directors, its officers, employees, subsidiaries, affiliates, agents, and co-branders or other partners, harmless from any claim or demand, including reasonable attorneys’ fees, made by you or any third party due to or arising out of services used by you and/or content you submit, post to or transmit through the service, your use of the service, your connection to the service, your violation of the terms of service, or your violation of any rights of another.
This agreement is governed by the Indian laws. You hereby consent to the exclusive jurisdiction and venue of courts in Mumbai India, in all disputes arising out of or in connection with these Conditions, the Site and/or the subject matter or any agreement between the guests/visitors and Safe Escapes, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration Rules of the Mumbai Centre for International Arbitration (“MCIA Rules”), which rules are deemed to be incorporated by reference in this clause.
Safe Escapes reserves the right to revise these terms and conditions and notices under which this website is offered and you agree to accept and be bound by those terms, conditions, and notices that are in effect at the time of your use of Safe Escapes website and facilities.
